Overview This website is operated by LitWits Workshops, LLC ("LitWits"). By purchasing from this site, you agree to be bound by these Terms of Service.

Use of Materials LitWits kits may include edible and natural items that may contain allergens. Please review all kit contents carefully before use.

Orders and Payment Orders are processed on a quarterly shipping schedule. See our Shipping Policy for details. All sales are final per our Refund Policy.

Release and Waiver of Liability In consideration for being permitted to participate in LitWits programs and/or use its materials and supplies, including edible and natural items that may contain allergens (the "Activity"), you, for yourself, your minor child or children, heirs, next of kin, spouse, legal and personal representatives and assigns, do hereby waive, release, and discharge LitWits Workshops, LLC and its owners, members, managers, officers, employees, contractors and agents ("Releasees") from liability from any and all claims, including the negligence of LitWits, resulting in personal injury (including death), accidents or illnesses, and property loss, in connection with participation in or use of the Activity.

Assumption of Risk Participation in the Activity carries inherent risks that cannot be eliminated regardless of the care taken to avoid injury. Risks range from minor injuries such as scratches, bruises, sprains, and mild allergic reactions, to major injuries such as serious allergic reactions and bodily harm, to catastrophic injuries including death. By completing your purchase, you accept these risks.

Indemnification You agree to indemnify, defend and hold LitWits harmless from any and all claims, actions, suits, costs, expenses, damages and liabilities, including attorney's fees, arising out of your or your minor child's participation in or use of the Activity.

Severability If any portion of these Terms is held invalid, the remaining portions will continue in full legal force and effect.

Governing Law These Terms shall be governed by the laws of the State of California. Any disputes shall be under the exclusive jurisdiction of the Courts of the State of California within Santa Cruz County.

IMPORTANT NOTICE THIS DOCUMENT RELIEVES LITWITS AND OTHERS FROM LIABILITY FOR PERSONAL INJURY, WRONGFUL DEATH, AND PROPERTY DAMAGE CAUSED BY NEGLIGENCE. BY COMPLETING YOUR PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND FULLY UNDERSTAND THESE TERMS, AND ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE.

If purchasing on behalf of a minor, you represent that you are the parent or legal guardian and have authority to agree to these terms on their behalf.
